Privacy Policy

In accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, "GDPR") and Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), PROSPERALEAD, S.L. informs the users of this website about how their personal data are processed and the rights they have.

2. What data we collect

We only collect the data you provide to us through our contact form, by email, by WhatsApp or during our business relationship:

  • Contact data: first name, last name, email address and phone number.
  • Professional data: company name, job title and, where you become a client, the company's tax and billing details.
  • Content of your request: the information you include in your message about the services you are interested in.
  • Browsing data: data collected through cookies, only where you have consented to them (see our Cookie Policy).

We do not process special categories of data (such as health, ideology or ethnic origin).

3. Purposes and legal bases

Sending information about services similar to those already contracted to existing clients. Legitimate interest (Art. 6.1.f GDPR and Art. 21.2 LSSI). You can object at any time and in every communication.
Maintaining contact with representatives of client and supplier companies in a professional context. Legitimate interest (Art. 6.1.f GDPR and Art. 19 LOPDGDD).
Customer support and service updates via WhatsApp. Your consent (Art. 6.1.a GDPR), see section 9.

We do not make decisions based solely on automated processing, nor do we create profiles that produce legal effects on you.

4. How long we keep your data

  • Enquiries that do not lead to a contract: for the time needed to handle your request and up to 12 months afterwards, in case you wish to resume contact.
  • Client data: for the duration of the business relationship and, afterwards, for the periods required by law (generally up to 6 years for commercial and accounting obligations, and 4 years for tax obligations).
  • Commercial communications: until you withdraw your consent or object to receiving them.

Once these periods have ended, data are deleted or kept blocked only for the time needed to address any possible legal liability.

5. Who we share your data with

We do not sell or transfer your personal data to third parties. Your data will only be disclosed where required by law (for example, to the Tax Agency, courts or public authorities).

To provide our services we rely on providers who process data on our behalf, under a data processing agreement and only following our instructions. These include providers of:

  • Website hosting and maintenance.
  • Email, office and cloud storage tools.
  • Customer relationship management (CRM).
  • Messaging services (WhatsApp Business, provided by Meta).
  • Accounting, tax and legal advisory services.

6. International transfers

Some of these providers (for example, Meta or Google) may process data outside the European Economic Area, in particular in the United States. In such cases, transfers are carried out on the basis of an adequacy decision of the European Commission (such as the EU-U.S. Data Privacy Framework) or the Standard Contractual Clauses approved by the European Commission.

7. Your rights

You may exercise the following rights at any time:

  • Access: know whether we process your data and obtain a copy.
  • Rectification: correct inaccurate or incomplete data.
  • Erasure: request the deletion of your data.
  • Restriction: ask us to limit the processing of your data in certain cases.
  • Objection: object to processing based on legitimate interest, including commercial communications.
  • Portability: receive your data in a structured, commonly used and machine-readable format.
  • Withdrawal of consent: where processing is based on consent, you may withdraw it at any time, without affecting the lawfulness of processing carried out before its withdrawal.

To exercise your rights, write to dpo@prosperalead.com indicating the right you wish to exercise. If we have reasonable doubts about your identity, we may ask you for additional information to confirm it. We will reply within one month.

If you believe your rights have not been respected, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) or with the supervisory authority of your country of residence.

8. Security

PROSPERALEAD, S.L. applies appropriate technical and organisational measures to protect your personal data against loss, alteration, unauthorised access or processing, taking into account the state of the art, the nature of the data and the risks involved.

9. Communications via WhatsApp

We offer a WhatsApp messaging service to provide customer support, service updates and notifications. By giving us your phone number and clicking "Subscribe", or by sending us a message, you consent to receiving communications related to our services through this channel.

You can unsubscribe at any time by sending "STOP" or "UNSUBSCRIBE" via WhatsApp. We will not share your phone number with third parties for marketing purposes. Please note that WhatsApp is a service provided by Meta, which processes data in accordance with its own privacy policy.

10. Minors

Our services are aimed at companies and professionals. This website is not directed at persons under 18, and we do not knowingly collect their data.
